This book explores the principles, practice and challenges in determining justice system responses to serious offending by children globally. Divided into four parts, the book provides a balance of theoretical and empirical insights. Anchored in a theoretical framework based on the human rights of children, as set out in the UN Convention on the Rights of the Child, it considers the relationship between scientific evidence (such as brain development) and the human rights framework, before going to explore the diversity of responses to children who are found responsible for serious offences. This book examines how attorneys enable a meaningful opportunity for release for individuals sentenced to life as juveniles. The work provides a detailed overview of how legal representation facilitates opportunities for release for juveniles sentenced to life: "juvenile lifers". It contributes to the broader literature on the importance of legal representation in the criminal legal system by investigating the role of an attorney in the parole process. Drawing on interviews with lawyers and qualitative content analyses of attorney participation in parole recordings from one state, the study illustrates how attorney assistance provides an important due process protection in the highly discretionary context of parole. The analysis of attorney representation is situated in the history of how they became prominent in the criminal legal system, and how their assistance has been viewed as vital in the parole process. Prior criminological and legal research relates the impact a lawyer can have by preparing a juvenile lifer candidate to present a suitable narrative for release, one that relates their diminished criminal culpability and rehabilitative efforts to prepare for life beyond prison. The work will be relevant to students, academics, and policy makers, particularly for state parole boards, public defender agencies, and legislatures. While the analysis is based on the experience of one state, the findings are generalizable to other states and countries that similarly conduct parole board hearings for not just their juvenile populations but also adults.
This book analyses the non-custodial government of young offenders in two major cities in Brazil. In doing so, it delves into the paradox of an institution exerting control over youths while at the same time promoting their autonomy and responsibility. The study sheds light on the specific logics of power, control, and inequality produced by such institutional settings. The book's analysis is based on an ethnographic study of 'Assisted Freedom' (Liberdade Assistida) - a form of probation - in the Brazilian cities of Rio de Janeiro and Belo Horizonte. This particular context - which is characterized by endemic violent crime, on the one hand, and a highly protective juvenile justice system, on the other - sheds productive light on the contradictions of juvenile justice systems and other public policies based on the values of citizenship, autonomy, and responsibilization. The analysis takes the form of an inverted zoom structure: it begins by looking at cognitive and interactional processes at the level of interpersonal relationships between youths and professionals, and then works its way up to examine ties outside the institution itself, with schools, the labour market, and juvenile courts. This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls' experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book investigates the Youth Police Initiative (YPI) intervention with a comprehensive look at its effects in Boston as well as Brownsville, Brooklyn, a neighborhood that has both rich community networks as well as the highest crime rate in New York City. The North American Family Institute began the YPI in Baltimore in 2003 with the ambition of keeping vulnerable youth away from arrests, gangs, guns, violence, and death. The program has been replicated in several communities in the United States and beyond. The focus of YPI training is to address the dual challenge of teaching youth the skills to resolve daily conflicts with authority while also teaching police officers to have meaningful dialogue with young people. Closing the Integration Gap in Criminology: The Case for Criminal Thinking offers a multi -stage model of theory integration that organizes verified risk factors around the construct of criminal thinking to provide an exemplar working paradigm for criminology. This monograph illuminates the connections between juvenile defense policies and the racially disparate impact of the juvenile justice system. The limited data that exist on youth in the juvenile justice system consistently depict disparate contact and outcomes for black youth across the system. The broad rehabilitative goals of the U.S. juvenile justice system, along with the "best interest" legal standard of the child welfare system, muddle the protection of youth due process rights. States differ widely in their policies granting defense counsel, and many policies lack specific language for policies addressing notions such as appointment timing, duration of representation, waiver criteria, and role of counsel. At the dawn of the twenty-first century, panic about girls' offending in Britain reached fever pitch. No longer sugar and spice, a 'new breed' of girl, the hedonistic, violent, binge-drinking 'ladette', was reported to have emerged. At the same time, the number of young women entering the youth justice system, including youth custody, increased dramatically. Offending Girls challenges simplistic and demonising popular representations of 'bad' girls and examines what exactly is new about the 'new' offending girl. In the light of enormous social and cultural changes affecting girls' lives, and expectations of them, since previous British research in this area, the book investigates whether popular stereotypes problematising female youthful behaviour resonate with the accounts of criminalised young women themselves, and to what extent they have infiltrated professional youth justice discourse. Through the lens of original detailed qualitative research in two Youth Offending Teams and a Secure Training Centre - the first study of its kind since the 'modernisation' of the youth justice system over a decade ago - Offending Girls questions whether the 'new' youth justice system is delivering justice for girls and young women. While there is extensive research published concerning juvenile justice and sentencing, most of the research focuses on individual and extra-legal factors, such as age, race, and gender, with scant attention paid to the impact of macro-level factors. This book assesses how a specific contextual factor-concentrated disadvantage-impacts juvenile court outcomes and considers the relevant implications for the current state of juvenile justice processing. Using case-level data from a Southern state with a large, diverse population and contextual-level data from the 2010 US Census and American Community Survey, Maroun assesses whether youth living in neighborhoods of concentrated disadvantage experience harsher outcomes than their counterparts from other types of neighborhoods. Additionally, she examines whether concentrated disadvantage interacts with individual race/ethnicity to influence juvenile court outcomes. Results suggested a direct impact of concentrated disadvantage on diversion, adjudication, and probation type. Further, race significantly interacted with concentrated disadvantage in impacting adjudication and probation outcomes, while ethnicity significantly interacted with concentrated disadvantage in impacting disposition and commitment type. This research expands the knowledge of macrolevel influences on juvenile court outcomes, providing support for the notion that community context impacts juvenile justice processing. Results also highlight the fact that judges use discretion as well as other legal and extralegal factors in exerting social control, and do so differently at each stage of processing.
