Self-Selection Policing introduces and explores an approach for crime control which seeks to identify active, serious offenders by attending to the minor offences they commit. A foundation of theory and evidence is first supplied for the assertion that 'those who do big bad things also do little bad things'. Original research presented in the book includes a study of offending by visitors to a prison, and the concurrent criminality of those committing common driving offences and failure to produce driving documents as required. It illustrates how self-selection can complement other police methods of identifying active, serious criminals by focusing on what offenders do rather than who they are and what they have done in the past. Concentrating on the 'usual suspects' in the conventional way is often criticised as harassment and self-selection policing largely bypasses the issue of fairness this raises. The book concludes with a call for the consideration, development and wider adoption of the self-selection approach, and particularly the identification of other common minor offences which flag concurrent active criminality. The authors make important suggestions for the progression of SSP research and practice, including the identification of barriers to the implementation of the approach in wider police thinking, practice and policy. Practical guidance is also provided for those thinking of developing, testing and implementing the approach. In doing so, the book will be of particular interest for policing practitioners, as well as students and scholars of policing and crime control.
This book explores the treatment of junevile offenders in modern Western history. The last few decades have witnessed major debates over youth justice policies. Juvenile and youth justice legislation has been reviewed in a number of countries. Despite the fact that new perspectives, such as restorative justice, have emerged, the debates have largely focused on issues that bring us back to the inception of juvenile justice: namely whether youth justice ought to be more akin to punitive adult criminal justice, or more sensitive to the welfare of youths. This issue has been at the core of policy choices that have given juvenile justice its orientations since the beginning of the twentieth century. It also gave shape to the evolution that paved the way for the creation of juvenile courts in the nineteenth century. Understanding those early debates is essential if we are to understand current debates, and place them into perspective. Based on primary archival research, this comprehensive study begins by presenting the roots, birth and evolution of juvenile justice, from the nineteenth century up to the beginning of the twenty-first. This book presents a detailed analysis of Hawaii's Opportunity Probation with Enforcement (HOPE) program. Developed by Judge Steven Alm in Hawaii in 2004, this model of 'swift, certain and fair' justice has been widely adopted across the United States. The book argues that although HOPE has principally been viewed in terms of its deterrent impact, it is in fact best understood through the lens of therapeutic jurisprudence and solution-focused courts, especially drug courts. Bartels presents a detailed overview of HOPE's operation, as well as a critical assessment of the evaluation findings of HOPE and other programs based on this model. While there is extensive research published concerning juvenile justice and sentencing, most of the research focuses on individual and extra-legal factors, such as age, race, and gender, with scant attention paid to the impact of macro-level factors. This book assesses how a specific contextual factor-concentrated disadvantage-impacts juvenile court outcomes and considers the relevant implications for the current state of juvenile justice processing. Using case-level data from a Southern state with a large, diverse population and contextual-level data from the 2010 US Census and American Community Survey, Maroun assesses whether youth living in neighborhoods of concentrated disadvantage experience harsher outcomes than their counterparts from other types of neighborhoods. Additionally, she examines whether concentrated disadvantage interacts with individual race/ethnicity to influence juvenile court outcomes. Results suggested a direct impact of concentrated disadvantage on diversion, adjudication, and probation type. Further, race significantly interacted with concentrated disadvantage in impacting adjudication and probation outcomes, while ethnicity significantly interacted with concentrated disadvantage in impacting disposition and commitment type. This research expands the knowledge of macrolevel influences on juvenile court outcomes, providing support for the notion that community context impacts juvenile justice processing. Results also highlight the fact that judges use discretion as well as other legal and extralegal factors in exerting social control, and do so differently at each stage of processing. Activists, policymakers, and scholars in the US have called for policy reform and evidence-based efforts to decrease the number of people in jail and prison, improve hostile police-community relations, and rollback the "tough on crime" movement. Given that poor people, particularly poor people of color, make up the majority of those under carceral control in Western, industrial countries, can technical solutions, gradual reforms, and individual-level programming genuinely change the deeply entrenched carceral state that has been expanding in the US for over 40 years? In this book, the authors offer an examination of the creative ideas that twelve US-based social justice organizations put forward for how participation in social change might spur not only individual-level change in young people, but community-wide mobilization against the harms resulting from the "tough on crime" movement and neoliberal policy. Using alternative programs grounded in political and social consciousness-raising, these organizations provide important and novel methods for how we might roll back carceral expansion. Their approaches resonate with scholarship in criminology and related fields; however, they sharply contrast with popular notions of "what works". The authors detail how community-based organizations must navigate not only these scientific forces, but the bureaucratic and financial ones consistent with neoliberal governance as well as the more formidable, less navigable political barriers that activate when organizations mobilize young people of color for social and carceral reform. The California youth corrections system is undergoing the most sweeping transformation in its 154-year history. The extraordinary nature of this change is revealed by the striking decline in the state's youth incarceration rate. In 1996, with 10,000 youth confined in 11 state-run correctional facilities, California boasted the nation's third highest youth incarceration rate. Now, with only 800 youth remaining in a system comprised of just three institutions, California has one of the nation's lowest youth incarceration rate. How did such unprecedented changes occur and what were the crucial conditions that produced them? Daniel E. Macallair answers these questions through an examination of the California youth corrections system's origins and evolution, and the patterns and practices that ultimately led to its demise. Beginning in the 19th century, California followed national juvenile justice trends by consigning abused, neglected, and delinquent youth to congregate care institutions known as reform schools. These institutions were characterized by their emphasis on regimentation, rigid structure, and harsh discipline. Behind the walls of these institutions, children and youth, who ranged in age from eight to 21, were subjected to unspeakable cruelties. Despite frequent public outcry, life in California reform schools changed little from the opening of the San Francisco Industrial School in 1859 to the dissolution of the California Youth Authority (CYA) in 2005. In this book, Irving Spergel details the efforts of his Chicago youth gang project, a comprehensive, community-based model designed to reduce gang problems, including violence and illegal drug activity. Originally published in 1940. This ground-breaking work formed the foundation for modern criminology becoming an academic discipline within UK sociological studies. It concerns the history of crime, its causes and treatment in England during the preceding twenty-five years or so. Mannheim, through this and later studies, went on to found the criminology department at LSE. The book offers an evaluation of the criminological implications of the War and early post-War period as well as an examination of the practical working of the new penal machinery built up by the Reform Acts passed just prior to the War. The author produced a scientific account of the post-War state of crime, beginning with a critical examination of the structure and interpretation of English Criminal Statistics followed by a survey of the principal criminological features of the period between the two Wars. Significant aspects are dealt with in a separate chapters - four devoted to problems of work and leisure (Unemployment and Strikes, Business Administration, Alcoholism, and Gambling), four others to those of certain specific sections of the population (Juvenile Delinquency, Female Delinquency and Prostitution, Recidivism). This is a fascinating read for both the historian and the criminologist.
Originally published in 1976. This study deals with crime as social history in Germany and France during the nineteenth century. It establishes the broad statistical patterns of crime over the century so that the crime phenomenon can be analysed in the light of the other main trends of economic and social life. One basic concern is the relationship between crime and economic condition. The second main issue is to establish whether specifically rural and urban patterns of crime can be isolated. The third main concern is to establish whether any relationship existed between patterns of delinquency and the social upheaval which accompanied industrialisation and urbanisation. These three main issues continue as important questions in considering modern day crime. Nineteenth century Germany and France provide an excellent context in which to examine them because of the substantial urbanisation and industrialisation which occurred between 1830 and 1914. As well as providing an important contribution to the history of nineteenth century society this book also indicates important lessons for the contemporary world.
This book analyses the non-custodial government of young offenders in two major cities in Brazil. In doing so, it delves into the paradox of an institution exerting control over youths while at the same time promoting their autonomy and responsibility. The study sheds light on the specific logics of power, control, and inequality produced by such institutional settings. The book's analysis is based on an ethnographic study of 'Assisted Freedom' (Liberdade Assistida) - a form of probation - in the Brazilian cities of Rio de Janeiro and Belo Horizonte. This particular context - which is characterized by endemic violent crime, on the one hand, and a highly protective juvenile justice system, on the other - sheds productive light on the contradictions of juvenile justice systems and other public policies based on the values of citizenship, autonomy, and responsibilization. The analysis takes the form of an inverted zoom structure: it begins by looking at cognitive and interactional processes at the level of interpersonal relationships between youths and professionals, and then works its way up to examine ties outside the institution itself, with schools, the labour market, and juvenile courts.
