This book, compiled from the 2nd Global Report of United Cities and Local Governments (UCLG) on Decentralization and Local Democracy, analyzes the architecture of fiscal decentralization in one hundred and ten countries as well as in major metropolitan areas. In the majority of these countries, local authorities are taking on more and more responsibilities for public investment and the provision of services that are essential for both economic development and the well being of their citizens. If increasing fiscal decentralization has been a global trend in recent decades, there are significant variations across and within regions and countries. Local budgets make up on average 25% of public expenditure in the countries of the European Union but less than 5% in many developing countries. Decentralization in terms of revenue and expenditure autonomy has also increased, however this has been uneven across countries and has seen greater advances in expenditure than in revenues, where sources remain limited and uncertain, especially for small and middle size cities. With accelerating urbanization and important shifts in the global context (climate change, increasing risk of natural disaster, migration, and demographic changes among others), current funding levels are insufficient for local governments to respond to the urbanization of poverty, growing investment requirements and other pressing needs. The economic and financial crisis that began in 2008 only worsened the situation. This report, offered as part of UCLG's ongoing commitment to deepen understanding of the level of government closest to citizens, identifies universal challenges facing local government finance, as well as those more regional and country specific. Some of the most common are inadequate sources of revenue, unpredictable transfers and grants, excessive higher-level budget controls, and unfunded mandates. In addition to analyzing these challenges and opportunities, the Report proposes recommendations to strengthen the fiscal role and performance of local governments around the world.

American Indian nations are sovereign political entities within the United States. They have complex relationships with the federal government and increasingly with state governments. Regulatory conflict between Native nations and states has increased as Native nations have developed their own independent economies and some states have sought to assert their control over reservation territory. This book explores the intergovernmental conflict between Native nations and states, with a focus on the tension over the enforcement of state cigarette taxes for on-reservation sales. Anne F. Boxberger Flaherty asks: when do states and Native nations come to agreement, when do they disagree, and why are states sometimes willing to extend great efforts to assert their taxes on reservations? Flaherty uses a multi-method approach, with a historical review of expanding state involvement on reservations, a quantitative analysis of state enforcement of cigarette taxes on reservations, and a qualitative analysis of several specific case studies, including the potential for intergovernmental conflict over marijuana cultivation and sales on reservations to answer these questions. This book examines the factors which contribute to local green development in China and employs political ecology to analyze the relationship between power and the environment. Specifically, it looks at which actors control access to resources and are therefore able to promote environmental progress. Following the reform and opening-up of China in the 1970s, entrepreneurs and local officials profited economically and politically and formed close relationships, known as guanxi in China. As a result, they have also been criticized as those responsible for the associated ecological damage. This book does not contest this association, but instead argues that the current literature places too much emphasis on their negative influence and the positive influence of their environmental work has been neglected. Building on three case studies where local green development is being pursued, Shanghai Pudong New Area, Baoding, and Wuning, this book shows how local officials and entrepreneurs can also be the crusaders of a greener environment at the local level in China. Creating metropolitan regions that are more efficient, equitable, and sustainable depends on the willingness of local officials to work together across municipal boundaries to solve large-scale problems. How do these local officials think? Why do they only sometimes cooperate? What kind of governance do they choose in the face of persistent problems? When the global financial crisis spread to Europe and its weak periphery through the banking sector, few contemplated that the real causes of the crisis did not reside only in the faulty architectures of globalisation and European integration but also in a pronounced power-shift to the 'global East'. In the post-war era one of the most significant transformations in the democratic process throughout Western Europe has been the widespread introduction of regional elections. Symptomatic of this decentralization has been the shift of various legislative powers to regional governing bodies. As a result, electorates throughout Western Europe now have more opportunities to express their preferences and air their grievances across electoral arenas while the dynamics of electoral competition have become increasingly multifarious and complex. This book offers a comprehensive overview of the role of parliamentary administrations in the control of European Union policy-making. It questions whether the decision to give parliaments greater powers in the aftermath of the Lisbon Treaty had only the intended effect of political debate on European policies, or whether it has also resulted in the bureaucratisation of parliaments. The authors argue that the challenges of information-management faced by parliaments lead them to delegate an extensive set of tasks to their administrations. They offer a broad empirical picture, analysing the challenges faced by national parliaments and the role and response of their administrations in the case of the European Parliament, national parliaments and regional parliaments. In addition, the book studies the interaction between different administrations and their contribution to interparliamentary cooperation. It presents a new and different perspective on the challenges and dynamics of multi-level parliamentarism.

First published in 1997, this volume presents the results of in-depth research into the application of the UK homelessness legislation in relation to community care, the Children Act 1989, violence to women, and racial harassment. This is supplemented with a consideration of policies and practices in 15 local authority homelessness departments. It is argued that government created the nation of a successful, or "appropriate" applicant, but this could not be translated into actual practice as the original legislation did not facilitate it. In fact, in the mid-1990s, government became more concerned with notions of inappropriateness, stereotyping those using the homelessness legislation and creating modern "folk devils". This was the background to the 1996 changes to the homelessness legislation which have created the notion of the "inappropriate" applicant. It is argued that the new legislation is more concerned with denial, deterrence and privatization. The new legislation has also detrimentally affected the application of the homelessness legislation in each of the areas discussed.

Approaching power transition through the lens of South Africa, Zwelethu Jolobe raises questions about how methods and types of mediation are understood, and their appropriateness for certain stages of negotiation processes. International Mediation in the South African Transition calls into question the generalisations about the determinants of success by international third parties in resolving internal conflicts. It moves from the position that the success of a mediation effort depends on the examination of the time horizon of a conflict and on the contribution the mediation effort plays in improving the relationship between the belligerents. Controversy surrounds Jewish settlements in the occupied West Bank, and the radical national and religious agendas at play there have come to define the area in the minds of many. This study, however, provides an alternative framework for understanding the process of "normalization" in the life of Jewish residents. Considering a wider range of historical and structural factors in which the colonization of the West Bank developed it allows placing its origins and everyday reality into a wider perspective. The works collected consider the transformation of the landscape, the patterns of relationships shared by the region's residents, Palestinian and Jewish alike, and the lasting effects of Israel's settlement policy. Stressed in particular are such factors as urban planning, rising inequality and the retreat of the welfare state, and the changing political economy of industry and employment. In doing so, the authors collected here provide new insight into the integration and segregation processes that are an integral part of the broader historical trends shaping Israel/Palestine.

This book, now available in paperback, is the result of national research conducted amongst England's directly elected mayors and the councillors that serve alongside them. It is the first such major publication to assess the impact on local politics of this new office and fills a gap in our understanding of how the Local Government Act 2000 has influenced local governance. The book also draws from a range of research that has focused on elected mayors - in England and overseas - to set out how the powers, roles and responsibilities of mayors and mayoral councils would need to change if English local politics is to fundamentally reconnect with citizens. This book is about why and how central and local governments clash over important national policy decisions. Its empirical focus is on the local politics of Japan which has significantly shaped, and been shaped by, larger developments in national politics. The book argues that since the 1990s, changes in the national political arena, fiscal and administrative decentralization, as well as broader socio-economic developments have led to a decoupling of once closely integrated national and local party systems in Japan. Such decoupling has led to a breakdown of symbiotic relations between the centre and regions. In its place are increasing strains between national and local governments leading to greater intra-party conflict, inter-governmental conflicts, and more chief executives with agendas and resources increasingly autonomous of the national ruling party. Although being a book primarily focused on the Japanese case, the study seeks to contribute to a broader understanding of how local partisans shape national policy-making. The book theorizes and investigates how the degree of state centralization, vertical integration for party organizations, and partisan congruence in different levels of government affect inter-governmental relations. Japan's experience is compared with Germany, Canada, and the UK to explore sources of multi-level policy conflict.

Attaining the benefits of (especially fiscal) decentralization in government remains an enduring challenge, in part because the re-arrangement of public functions across levels of government has often been carried out poorly. This book aims to provide a firmer conceptual basis for the re-arrangement of public functions across levels of government. In doing so, it offers practical advice for policy makers from developing and emerging countries and development cooperation practitioners engaged in such activity. Combining a theoretical approach for inter-governmental functional assignment with an in-depth analysis of real-life country cases where functional assignment (FA) has been supported in the context of international development cooperation, it underscores the common technical and political challenges of FA, and also demonstrates the need to expect and support country made and context-specific solutions to FA processes and results. In today's world, citizenship is increasingly defined in normative terms. Political belonging comes to be equated with specific norms, values and appropriate behaviour, with distinctions made between virtuous, desirable citizens and deviant, undesirable ones. In this book, we analyze the formulation, implementation, and contestation of such normative framings of citizenship, which we term 'citizenship agendas'. Some of these agendas are part and parcel of the working of the nation-state. Other citizenship agendas, however, are produced beyond the nation-state. The chapters in this book study various sites where the meaning of 'the good citizen' is framed and negotiated in different ways by state and non-state actors. We explore how multiple normative framings of citizenship may coexist in apparent harmony, or merge, or clash. The different chapters in this book engage with citizenship agendas in a range of contexts, from security policies and social housing in Dutch cities to state-like but extralegal organizations in Jamaica and Guatemala, and from the regulation of the Muslim call to prayer in the US Midwest to post-conflict reconstruction in Lebanon. This comprehensive edited volume conceptually develops the notion of 'de-Europeanisation' as an important development in the literature on Europeanisation, and applies it specifically to the case of Turkey. 'De-Europeanisation' is defined as the loss or weakening of the EU/Europe as a normative/political context and as a reference point in domestic settings and national public debates of both candidate and member countries. 'De-Europeanisation' manifests itself in two basic ways: as the weakening of the appeal and influential capacity of European institutions, policies, norms and values, leading to a retreat of EU/ Europe as a normative/political context for society and politics in a candidate/member state; and as growing scepticism and indifference in a given society towards the EU/Europe, risking the legitimacy of the EU/Europe as a reference point in cases even where reform is incurred. Using this concept, the authors analyse the diminishing impact of the EU in Turkish governance and politics after the opening of accession negotiations in October 2005. The relevance of 'de-Europeanisation' is investigated through ten chapters focusing on key policy areas including education, migration, democracy, the rule of law and media freedoms, and a number of key actors including civil society organisations, political parties and political leaders. The events of recent history affirm the urgent need for a satisfactory definition of the conditions under which a minority within a state has the legal right to secede. Although the concept of sovereignty has been progressively weakened, it still presents the major theoretical difficulty in this area. There is currently no source of international law that would give a legal body like a court the authority to recognize the division of an oppressive or illegitimate state into separate legal entities. This book accordingly argues for a global system of justice based on a domestic model of compulsory law. It considers some of the technical, procedural and evidentiary issues that would arise in instituting such a regime, and develops the conceptual framework essential for the provision of legal remedies for gross violations of our fundamental human rights.

To what extent can a non-state actor resembling a government be regulated by human rights principles? This study is the first detailed human rights analysis of Hamas conduct and governance in the Gaza Strip. Drawing on reports and resolutions from the United Nations and local and international human rights organizations, the author considers four years of uncontested Hamas control over the area and suggests a normative framework for evaluating Hamas conduct according to international human rights standards and degree of influence over the public sphere in the absence of more formally binding obligations.

Sudden change in North Africa manifested through popular protests followed by the end of authoritarian regimes in Tunisia, Egypt and Libya revitalised the scholarly concern with democracy in the region. Democratisation and democracy received fresh attention in the 'Arab Spring'. Arab citizens displayed their grasp and possession of 'democratic knowledge' in a bottom-up groundswell of activism against the wielding of power by authoritarian regimes. In this book, the investigation into democratic knowledge revolves around the idea that good government must be in the first instance rooted in a local system of knowledge. However, no privileging of the 'local' is offered here at the expense of the 'democratic'. Each chapter illustrates the context-specific experiences which provide political actors with the wherewithal in actively learning democracy. The countries examined with reference to a socially constructed democratic knowledge include Algeria, Libya, Morocco, Tunisia and Egypt. Critical focus on local agency in North Africa during the 'Arab Spring' enables a shift from democratisation as an ideology to a 'democratic learning turn'.
