Therapists once promised patients "Everything you tell me will remain in this room." Today, they can keep that promise only if they are willing to break the laws that now require them to disclose information without patient consent. Most avoid such civil disobedience by placing limits on confidentiality; but ethically speaking, this 'conditional' confidentiality can be difficult to practice. The Ethics of Conditional Confidentiality: A Practice Model for Mental Health Professionals is a guidebook designed to help therapists and other mental health professionals navigate the ethical and legal maze surrounding confidentiality. At its core is a practical Confidentiality Practice Model-a step-by-step guide for clarifying the ethical and legal issues that make the ethics of conditional confidentiality so complicated. Ethics codes represent the 'ethical floor,' which is the minimum standard of behavior about confidentiality. The goal in this book is to encourage reaching for the 'ethical ceiling,' by protecting confidentiality to the extent legally possible and not disclosing patients' confidences just because certain laws would allow them to be disclosed. The Ethics of Conditional Confidentiality demystifies confidentiality for therapists, clinical supervisors, educators, ethics consultants, attorneys who represent mental health professionals, clinicians, and administrators, and is an ideal supplemental ethics text for graduate courses. It is also useful for establishing confidentiality policies in any clinical setting and training program.

The impetus for this volume began with our research in the 1980's involving serial neuropsychological evaluation with various patient populations. At that time, reports on the practice effects associated with routinely utilized clinical neuropsychological instruments were sparse. While test-retest data were available for almost all assessment instruments, this was usually in the form of correlation coefficients and not changes in mean performance between or across assessment periods (see McCaffrey & Westervelt, 1995 for a detailed discussion of these and related issues). Clinical neuropsychological practitioners had few guidelines to assist them in determining if a change in a patient's performance across assessments was due to an intervention, maturation, practice effects, or a combination of factors. This volume represents our efforts at reviewing the literature between 1970 and 1998 and extracting the reported information on practice effects. The tables include the assessment instrument used, information on the subject/patient groups, the sample size (n}, gender, age, intervention, interval between the assessments, scores at both assessment points, and the citation. Those studies that reported data on more than two assessment points are indicated by a notation~ however, any data beyond the second assessment are not reported and the interested reader should refer to the original article. The tables are arranged alphabetically for the most widely used assessment instruments. Those instruments for which there was limited data on practice effects are grouped by "domain" (e. g.

The theoretical and empirical advances relate, first, to analyses of the nature and extent ofyouth crime. This is reflected, for example, in various descriptive and classification systems developed for characterizingjuvenile offenders. Significant advances are also being made in understanding the risk factors associated with youthful criminal activity, as well as the processes linking the risk factors with antisocial behaviors. This understanding is based on theory and research relatingto the correlates andcauses ofdelinquency. The advances in our understanding of the nature, correlates, and causes of juvenile crime are accompanied by progress in analyzing the treatment ofyouth in juvenile justice systems and in developing and evaluating alternative approaches to treatment. These efforts include research on decision-making within juvenile justice systems and the development of screening and assessment tools. This also includes efforts to develop and evaluate effective prevention and treatment programs for use with youths involved in criminal activity and those at risk for this activity.

This book was inspired by an intimate, stimulating, intellectually enrich ing conference that took place in Poland. However, the book is not a conference report. Rather, at the time of the conference, participants agreed that it would be worthwhile to create a volume representing the international state of knowledge in pro social behavior, and many of them agreed to write chapters. This volume is the outcome. The book contains chapters by outstanding researchers and scholars who have made substantial contributions to some aspect of scholarship about pro social behavior-helpfulness, generosity, kindness, coopera tion, or other behavior that benefits people. The book concerns itself with how prosocial behavior comes about and what influences contrib ute to or inhibit it; how prosocial behavior, or values and other personal characteristics that promote prosocial behavior, develop; how socializa tion, peer interaction, and other experiences contribute to development; and with the cognitive, emotional, and behavioral consequences of re ceiving help. Some chapters directly, and a number of them implicitly, concern themselves with applications of knowledge about prosocial be havior, particularly with the question of how cooperation and behavior that benefits other people can be promoted. The purpose of the book is. in part to show where the field stands and what knowledge we have accumulated, and in part to suggest fu ture directions and advance the field. It is a truly international book, with contributors from most countries where research on pro social be havior is being conducted."

Punishment of offenders is one of the most universal features of human behavior. Throughout history, ranging across a multitude of cultures including the ancient hunter-gatherers to our contemporary courts of law, it is extraordinarily common for people to punish offenders within their groups. By the same token, it's important to understand that punishment is not only restricted to criminal offenders, but actually emerges within all spheres of our social life, including: corporations, our public institutions, in traffic, during sports matches, in our schools, and more. Punishment strongly influences what we think, how we feel, and what we do. As President of the American Academy of Psychiatry and the Law (AAPL), it is my pleasure to provide this Foreword for the third volume of Critical Issues in American Psychiatry and the Law. Through Dr. Richard Rosner's creativity and effort, the first volume of the series was pub lished in 1982. It represented the first major publishing activity of the AAPL other than the Bulletin and the Newsletter. Dr. Rosner carefully nurtured the project and the second volume, once again addressing a broad range of forensic issues, was published in 1985. The appearance of the third volume brings two major changes to the series. Dr. Rosner shares editorship of this volume with Harold I. Schwartz, and this is the first of the series to be devoted entirely to one area in forensic psychiatry, the elderly. This is a priority subject. As the baby boom ages and technology for extending life increases, the profile of our population is maturing. The aging of the nation brings with it problems of chronic care, the dementias, the fear of prolonging dying rather than extending meaningful life, the social question of increasing health care costs, and the medical and human question of legal and ethical protection of the elderly patient. This volume could not be more timely. As Bernice Neugarten has pointed out, we must avoid stereotyping the elderly.l Many individuals bring to older age a rich repertoire of interests, abilities, and insights. Among the elderly are the young-old."

During the 1980s, those of us who were involved in forensic psychiatry have seen an increase in the interest in our subspecialty. This increased interest has been from psychiatrists, lawyers, judges, and correctional officials as well. As a part of this demand for our services, there has also been an increase in the demand for detailed quality in our reports and testimony. Whether this is the result of the educational efforts of the American Academy of Psychiatry and the Law, the establishment of the American Board of Forensic Psychiatry, the stimulation of thought by the publication of this series, Critical Issues in American Psychiatry and the Law, or Supreme Court decisions such as Ake v Oklahoma is anybody's guess. My experience as an observer of the development of the patient's rights movement was that there was a coalescence of numerous forces, such as the new human rights movement, the active mental health bar, and the development of neuroleptics. I therefore suspect that there are a multitude of factors contributing to the new interest in forensic psychia try and the elevation of the standards of forensic experts. Regardless of the causes, those who are practicing forensic psychiatry today are ex pected to conduct more thorough evaluations and to report findings more completely. No longer will simple conclusory statements be accept able. The forensic psychiatrist is expected to present data in a clear, understandable, detailed, reliable, and competent fashion whether testi fying or in a report."

The systematic application of behavioral psychology to crime and delinquency was begun only 20 years ago, yet it has already contributed significantly to our practical knowledge about prevention and correction and to our general under standing of a pressing social problem. In this handbook, we review and evalu ate what has been accomplished to date, as well as what is currently at the leading edge of the field. We do so in order to present a clear, comprehensive, and systematic view of the field and to promote and encourage still more effective action and social policy reform in the future. Adolescent and child sexuality is studied by developmental psychologists from a research perspective and is of interest to forensic psychologists dealing with abuse and custody issues as well as rape cases. In many cases, it is of interest whether the child in question was sexually active to understand the extent to which an underage minor might have voluntarily participated in sexual activity as opposed to having been coerced. Previously, researchers interested in the applications of their research needed to look to separate books, and forensic specialists needed to look to development books to find the information they may have needed. Benjamin Lee Center for Psychosocial Studies On March 29-April 1, 1979, the Center for Psychosocial Studies held a conference in Chicago on "New Approaches to the Self" in which all the authors in this volume partici- pated. Over the years the Center has acted as a communica- tions link and coordination point for interdisciplinary dis- cussions and research. Several years ago, we discovered that there was a renewed interest among psychoanalysts, anthro- pologists, and developmental psychologists in the investiga- tion of the self, and the reason for this groundswell of ac- tivity was the discovery of the importance of problems of meaning and interpretation in each discipline. Since inves- tigators in each of these disciplines were relatively ignor- ant of developments in the other approaches, we felt that a conference would be a timely catalyst. Each of the authors gave a presentation at the conference, and it is a mark of the success of the interdisciplinary effort that almost all the papers were extensively revised in response to the dis- cussions. The first three papers by Arnold Goldberg, Ernest Wolf, and Robert LeVine all use Heinz Kohut's psychoanalytic self psychology as their starting point. Goldberg places the self within a broader framework of philosophical and psychoana- lytic theories, finally locating it in the types of communi- cative relationships a person constructs in his interactions with others. Wolf's paper explicates the basic ideas and innovations of Kohut's self psychology.

The title that the authors have chosen for this book, The Causes and Cures of Criminality, suggests that it may be just another book specu lating on the sociological evils that need to be put right for "everything in the garden to be lovely." If this is the expectation, the reader could not be more mistaken. The recurrent theme, in fact, is a strong accent on psychological experiments. Both authors have tackled the theoretical and practical side of crime through an exhaustive literature review of past experi mental work. Hans J. Eysenck has concentrated on the constitutional and biological theory of criminality, whereas Gisli Gudjonsson has con cerned himself more with a review of ongoing research into therapy and possible prevention of antisocial behavior. Part I goes into considerable detail on the causes of criminality, stressing much of the strangely neglected area of individual differences in personality. Research studies point to a very heavy involvement of heredity in the causation of criminality, but the authors are careful to acknowledge that much can be done environmentally to discourage a life of crime once those persons who are at risk have been identified."

Emergence of Individual Differences in Social Context ROBERT B. ZAJONC A priest who was a heavy smoker once asked his bishop if it was all right if he smoked while praying. Appalled, the bishop chastised the priest for the very thought of soiling the solemn moment of prayer with such a filthy habit. Some years passed and the bishop came again through our priest's parish. And our tormented priest asked again about his predicament. But he asked a somewhat different question: "Your excellency," he said, "is it all right to pray while smoking?" There was no hesitation in the bishop's answer. "Of course " he said. "There is nothing in the world that should keep you from praying. You can always pray, my son. You should miss no opportunity to pray. Whenever you wish to pray, by all means pray " The relationship between individual differences and social psychology is roughly the same as between smoking and praying. Many social psychologists, and especially experimental social psycholOgists, are openly disdainful of individ ual difference variables. They avoid them in their studies and refuse to incor porate them in theories. The reasons for their (and we really should say "my" because the author is no exception in this matter) attitude are not obvious."

Secure Recovery is the first text to tackle the challenge of recovery-oriented mental health care in forensic services and prison-based therapeutic communities in the UK. Recovery as an emergent paradigm in the field of mental health presents a challenge to all services to embrace a new clinical philosophy, but nowhere are the implications more profound than in services that are designed to meet the needs of mentally disordered and personality-disordered offenders, both men and women. This book predominantly explores the psychic histories of patients who display their transgenerational conflicts/trauma through forensic acts. It establishes the need to consider the details of patient history in understanding the patient within both the therapeutic encounter and the treatment team milieu. There are many themes of contemporary interest including gang murders, sibling jealousy, fatal eating disorder, personality disorder, and the effects of exclusion and marginalization within group and community dynamics and the global prevalence of mass murder. Peter Aylward describes the collapse into dyadic thinking and enactment that prevails when the third perspective, classically represented by the father within the Oedipal dynamic, is excluded or absent. Providing detailed case studies he shows how seemingly meaningless explosions of violence or perversion are attempts to master early experiences of trauma and/or exclusion, often passed down unconsciously through the generations. Using the theories of Matte Blanco and notions of the "critical date" the chapters give unique insight into the timing and triggers of crimes, however apparently random.The final chapter, on the Dunblane Massacre, illuminates the thinking in previous chapters about the crucial importance of triangulating to militate against exclusion/marginalization whose humiliating feelings can be the bedrock of not only the paedophilic and anorexic but more strikingly the murderous impulse. The significant implications for the penal, health and particularly the education system are discussed with recommendations suggested. This is endorsed in the foreword by Lord Alderdice who writes that "it is in the interests of communities to act through informed understanding and I very much hope that his (Aylward s) lead is followed ."

Ira Lipman Marvin Wolfgang was the greatest criminologist in the United States of America in the last half of the 20th century, if not the entire century. We first met on March 3, 1977, in Philadelphia. I sought him out after his work with Edwin Newman's NBC Reports: Violence in America. He was a tender, loving, caring individual who loved excellence-whether it be an intellectual challenge, the arts or any other pursuit. It is a great privilege to take part in honoring Marvin Wolfgang, a great American. Our approaches to the subject of crime came from different perspectives one as a researcher and the other as the founder of one of the world's largest security services companies. We both wanted to understand the causes of crime, and our discussions began a more than 21-year friendship, based on mutual respect and shared values. Dr. Wolfgang's scholarship aimed for the goal of promoting a safer, more prosperous society, one in which economic opportunity replaced criminal enterprise. He never saw crime in isolation but as part of a complex web of social relations. Only by understanding the causes and patterns of crime can society find ways to prevent it. Only through scholarship can the criminal justice community influence policy makers. To encourage the innovative scholarship that marked Marvin's career, Guardsmark established the Lipman Criminology Library at the University of Pennsylvania, at his request, and created a national criminology award in his name, the Wolfgang Award for Distinguished Achievement in Criminology."

Olof Dahlb ck's book breaks new ground for the analysis of crime from a rationality perspective by presenting models and methods that go far beyond those with which researchers have hitherto been equipped. The book examines single crimes, individual criminality, and societal crime, and it discusses thoroughly the general decision theoretical presuppositions necessary for analyzing these various types of crime. An expected utility maximization model for a single discrete choice regarding the commission of a crime is the foundation of most of the analyses presented. A version of this model is developed that permits interpersonal comparisons, and this basic model is used when deriving more complex models of crime as well as when analyzing the potential for such derivations. The rigorous, powerful methods suggested provide considerable opportunities for improving research and for seeing old problems in a new light.

Besides generating wealth, globalization makes victims, including victims of new forms of crime. In this edited book of scholarly essays, international lawyers and criminologists reflect on the legal challenges posed by these dark sides of globalization. Examples include transnational organised crime, human trafficking and corruption, cyber crimes, international terrorism, global corporate crime and cross-border environmental crimes. The authors reflect on the limits of domestic systems of justice in providing protection, empowerment and redress to the victims of these emerging forms of global insecurity. They argue for the need of better international or supra-national institutional arrangements such as legal instruments and actions of the United Nations or regional organizations such as the European Union.

In part I Jan Van Dijk and Rianne Letschert present an overview of trends in criminal victimization against the backdrop of globalization using a unique set of statistical indicators. By placing this issue in the framework of the human security concept, the authors draw out its broader political and normative implications. Theologist Ralf Bodelier explains how modern communication technologies have heightened sensitivities among the general public for human insecurities anywhere in the world. In his view, a new global conscience is in the making that may become the cornerstone of international solidarity and action. Marc Groenhuijsen and Rianne Letschert describe the emergence of national and international legal and institutional arrangements to offer remedies to victims of crime in an era of globalization.

In part II a selection of experts analyse the specific issues surrounding the protection and empowerment of victims of different types of international crimes such as human trafficking, organised crime/corruption, terrorism, global corporate crime and cross border environmental crimes. In part III focused attention is given to the special challenges and opportunities of protecting and assisting crime victims in cyberspace. Part IV deals with emerging victim issues in humanitarian law such as the accountability of private military companies and the implementation of the ambitious victim provisions in the statute of the International Criminal Court including the establishment of a global fund for reparations.

In the final part of the book some of its core authors formulate their ideas about the international institutional arrangements that should be put in place to offer justice to the victims of globalization. A concrete proposal is made for the transformation of the United Nations 1985 Declaration on the Principles of Justice for Victims of Crime and Abuse of Power into a full-fledged UN convention. In the final chapter further proposals are made for the increased involvement of regional organisations such as the European Union in the protection of victims of global crime.

Suicide kills and maims victims; traumatizes loved ones; preoccupies clinicians; and costs health care and emergency agencies fortunes. It should therefore demand a wealth of theoretical, scientific, and fiduciary attention. But in many ways it has Why? Although the answer to this question is multi-faceted, this volume not. supposes that one answer to the question is a lack of elaborated and penetrating theoretical approaches. The authors of this volume were challenged to apply their considerable theoretical wherewithal to this state of affairs. They have risen to this challenge admirably, in that several ambitious ideas are presented and developed. Ifever a phenomenon should inspire humility, it is suicide, and the volume's authors realize this. Although several far-reaching views are proposed, they are pitched as first approximations, with the primary goal of stimulating still more conceptual and empirical work. A pressing issue in suicide science is the topic of clinical interventions, and clinical approaches more generally. Here too, this volume contributes, covering such topics as therapeutics and prevention, comorbidity, special populations, and clinicalrisk factors.

The insanity defense debate has come full circle, again. The current round began when John Hinckley opened fire; in 1843, it was Daniel M'Naghten who pulled the trigger; the "acts" of both would-be "insanity acquittees" provoked the press, the populace, a President, and a Queen to expressions of outrage, and triggered Congress, the House of Lords, judges, jurists, psychologists, and psychiatrists to debate this most maddening matter. "Insanity" -which has historically been surrounded by defenses, defen ders, and detractors-found itself once again under siege, on trial, and undergoing rigorous cross-examination. Treatises were written on the sub ject, testimony was taken, and new rules and laws were adopted. The dust has settled, but it has not cleared. What is clear to me is that we have got it wrong, once again. The "full circle" analogy and historical parallel to M'Naghten (1843) warrant some elaboration. Hinckley's firing at the President, captured by television and rerun again and again, rekindled an old debate regarding the allegedly insane and punishment (Caplan, 1984; Maeder, 1985; Szasz, 1987), a debate in which the "insanity defense" is centrally situated. The smolderings ignited anew when the Hinckley (1981) jury brought in its verdict-"not guilty by reason of insanity" (NGRI)."
