Following the vexed codification attempts of the International Law Commission and the relevant jurisprudence of the International Court of Justice, this book addresses the permissibility of the practice of diplomatic asylum under general international law. In the light of a wealth of recent practice, most prominently the case of Julian Assange, the main objective of this book is to ascertain whether or not the practice of granting asylum within the premises of the diplomatic mission finds foundation under general international law. In doing so, it explores the legal framework of the Vienna Convention on Diplomatic Relations 1961, the regional treaty framework of Latin America, customary international law, and a possible legal basis for the practice on the basis of humanitarian considerations. In cases where the practice takes place without a legal basis, this book aims to contribute to bridging the legal lacuna created by the rigid nature of international diplomatic law with the absolute nature of the inviolability of the mission premises facilitating the continuation of the practice of diplomatic asylum even where it is without legal foundation. It does so by proposing solutions to the problem of diplomatic asylum. This book also aims to establish the extent to which international law relating to diplomatic asylum may presently find itself within a period of transformation indicative of both a change in the nature of the practice as well as exploring whether recent notions of humanity are superseding the traditional fundaments of the international legal system in this regard.

In this book, Positional Realism is proposed as a new theory to define the overall national interests from the power position and order position perspectives and specify the four kinds of positional interests of hegemonic states, contending states, potential contending states, and non-contending states. Different great powers have different positional power and order objectives. Based on these positional interests, Positional Realism brings different foreign policy hypotheses and suggestions. The book also examines the six great powers in the nineteenth century to verify these hypotheses and finds that Positional Realism can not only convincingly explain the success or failure of their acts, but also give useful and important directions for strategy making of great powers.

Japan's Foreign Aid Policy in Africa seeks to evaluate TICAD's intellectual contribution to and its development practices regarding Africa over the past 20 years. A central conclusion is that, while TICAD bureaucrats lacked agency to support Japanese companies in Africa, the model of emerging powers partnerships has expanded in Africa.

Richard, Marquess Wellesley (1760-1842) became one of the most controversial politicians of his generation during his time as Governor-General of Bengal (1798-1805). Although this period saw him achieve territorial gains and military victories in India - including the defeat of Tipu Sultan, the ruler of Mysore - the financial cost was considered too high. The East India Company Court of Directors in London disagreed with many of the changes he made, and Wellesley was forced to return to England. This five volume collection of papers, edited by the political activist and historian Robert Montgomery Martin (1800-1868), was published in 1836-1837 and documents Wellesley's period of office in India. Volume 5 contains materials that supplement those in the four earlier volumes. They focus on large undertakings such as the Mysore and Maratha Wars, as well as topics including the East India Company's finances during Wellesley's tenure.

Examining diversity as a fundamental reality of empire, this book explores European colonial empires, both terrestrial and maritime, to show how they addressed the questions of how to manage diversity. These questions range from the local to the supra-regional, and from the management of people to that of political and judicial systems. Taking an intersectional approach incorporating categories such as race, religion, subjecthood and social and legal status, the contributions of the volume show how old and new modes of creating social difference took shape in an increasingly early modern globalized world, and what contemporary legacies these 'diversity formations' left behind. This volume show diversity and imperial projects to be both contentious and mutually constitutive: one the one hand, the conditions of empire created divisions between people through official categorizations (such as racial classifications and designations of subjecthood) and through discriminately applied extractive policies, from taxation to slavery. On the other hand, imperial subjects, communities, and polities within and adjacent to empire asserted themselves through a diverse range of affiliations and identities that challenged any notion of a unilateral, universal imperial authority. This book highlights the multidimensionality and interconnectedness of diversity in imperial settings and will be useful reading to students and scholars of the history of colonial Empires, global history, and race.

How, despite the enormous investment of blood and treasure, has the West's ten-year intervention left Afghanistan so lawless and insecure? The answer is more insidious than any conspiracy, for it begins with a profound lack of understanding of the rule of law, the very thing that most dramatically separates Western societies from the benighted ones in which they increasingly intervene. This volume of essays argues that the rule of law is not a set of institutions that can be exported lock, stock and barrel to lawless lands, but a state of affairs under which ordinary people and officials of the state itself feel it makes sense to act within the law. This book explores British post-colonial foreign policy towards Kenya from 1963 to 1980. It reveals the extent and nature of continued British government influence in Kenya after independence. This is a book that will change the American perception of the Pacific War. One important question is: Who actually started the Pacific War? By examining recently discovered facts revealed through the declassification of official documents, the decoding of secret communications between the Soviet Union and its operatives, and findings from American and Japanese writers in recent decades, the author clarifies the role played by President Franklin D. Roosevelt and members of his cabinet in pushing Japan to the brink of war. Another notable analysis concerns the U.S. occupation of Japan immediately after the war. The author finds it as a spectacular success in politically castrating Japan. The impact is still clearly observable. Many Japanese have lost the sense of nationhood as a result. The author examines the historical background of U.S.-Japan relations from the visit of Commodore Matthew Perry in 1853 to the present day. Utilized a wealth of Japanese as well as American materials, he presents a view of the history of the two countries. He finds that Japan was not very skillful in utilizing code-breaking or information-warfare, but tried to liberate colonies in Asia and Africa, and indeed her effort was successful and ultimately resulted in the loss of Western Colonies including India, Indonesia, Burma, and Malaysia.
