The Value of Wellness in the Workplace - A Perspective of the Employee-Organisation Relationship in the South African Labour... The Value of Wellness in the Workplace - A Perspective of the Employee-Organisation Relationship in the South African Labour Market (Paperback, 2015 ed.)
Bennie Linde
R1,760 Discovery Miles 17 600 Ships in 10 - 15 working days

This book examines the links between employee-organisation relationships, work wellness and the impact thereof on the labour market from a South African perspective. By employing this focus, the book explains the role of the employment relationship and the psychological contract in improving work wellness. To do so, it reviews the establishment and management of contracts in the context of labour relations at South African organisations. The studies presented focus on a range of topics, from individual wellness, the employment relationship and psychological contract, to relational wellness, the broader labour approach, and industrial action. The book presents a structural framework from an individual and labour relational perspective that links the employee-organisation relationship with wellness and its economic value, making it of interest to general and financial managers seeking to better grasp the link between work wellness and its financial implications.

The Workplace Constitution from the New Deal to the New Right (Paperback): Sophia Z. Lee The Workplace Constitution from the New Deal to the New Right (Paperback)
Sophia Z. Lee
R900 Discovery Miles 9 000 Ships in 12 - 17 working days

Today, most Americans lack constitutional rights on the job. Instead of enjoying free speech or privacy, they can be fired for almost any reason or no reason at all. This book uses history to explain why. It takes readers back to the 1930s and 1940s when advocates across the political spectrum - labor leaders, civil rights advocates and conservatives opposed to government regulation - set out to enshrine constitutional rights in the workplace. The book tells their interlocking stories of fighting for constitutional protections for American workers, recovers their surprising successes, explains their ultimate failure, and helps readers assess this outcome.

East Asian Labor and Employment Law - International and Comparative Context (Paperback): Ronald C. Brown East Asian Labor and Employment Law - International and Comparative Context (Paperback)
Ronald C. Brown
R1,518 Discovery Miles 15 180 Ships in 12 - 17 working days

This book deals with international labor and employment law in the East Asia Region (EA), particularly dealing with China, South Korea and Japan. It explores and explains the effects of globalization and discusses the role played by international labor law as it affects lawyers, business, labor, labor unions and human resource management, and the labor issues that can arise in dealing in EA trade and investment. The text, and the readings (from area experts), are organized and written to provide the reader with, first, a broad understanding and insight into the global dimensions of the fast-emerging area of labor and employment issues (e.g., global legal standards and their interplay with domestic and foreign laws); and second, to show how these laws and approaches play out in specific EA countries (comparing global approaches with the specific laws of each country on four common agenda items: regulatory administration, workers' rights, trade unions and dispute resolution).

International Framework Agreements - Hintergrund, Rechtsnatur Und Justiziabilitaet (German, Hardcover): Bernd Waas International Framework Agreements - Hintergrund, Rechtsnatur Und Justiziabilitaet (German, Hardcover)
Bernd Waas; Elisa Theresa Hauch
R1,695 Discovery Miles 16 950 Ships in 12 - 17 working days

Home Care Fault Lines - Understanding Tensions and Creating Alliances (Hardcover): Cynthia J Cranford Home Care Fault Lines - Understanding Tensions and Creating Alliances (Hardcover)
Cynthia J Cranford
R2,974 Discovery Miles 29 740 Ships in 12 - 17 working days

In this revealing look at home care, Cynthia J. Cranford illustrates how elderly and disabled people and the immigrant women workers who assist them in daily activities develop meaningful relationships even when their different ages, abilities, races, nationalities, and socioeconomic backgrounds generate tension. As Cranford shows, workers can experience devaluation within racialized and gendered class hierarchies, which shapes their pursuit of security. Cranford analyzes the tensions, alliances, and compromises between security for workers and flexibility for elderly and disabled people, and she argues that workers and recipients negotiate flexibility and security within intersecting inequalities in varying ways depending on multiple interacting dynamics. What comes through from Cranford's analysis is the need for deeply democratic alliances across multiple axes of inequality. To support both flexible care and secure work, she argues for an intimate community unionism that advocates for universal state funding, designs culturally sensitive labor market intermediaries run by workers and recipients to help people find jobs or workers, and addresses everyday tensions in home workplaces.

Discrimination Law (Paperback, 3rd Revised edition): Sandra Fredman FBA KC Discrimination Law (Paperback, 3rd Revised edition)
Sandra Fredman FBA KC
R1,641 Discovery Miles 16 410 Ships in 12 - 17 working days

This book is a challenging, thought-provoking yet highly accessible introduction to discrimination law. It takes a thematic approach, illuminating the major issues in discrimination law, while imparting an in-depth understanding of the strengths and weaknesses of legal responses to complex social problems of inequality. This is enhanced by the comparative approach. By considering equality law in the UK, US, India, Canada, and South Africa, as well as the European Union and under the European Convention on Human Rights, the book exposes common problems across different jurisdictions and canvasses a variety of differing solutions. As in the highly successful previous editions, the book locates discrimination law within its historical and social context. One of its major strengths is the development of an analytic framework of substantive equality, drawing on a range of sources, and the author's wide experience of equality law in many jurisdictions. As well as chapters charting the social challenges and legal responses, the book compares the ways in which different jurisdictions formulate grounds of discrimination or protected characteristics; the meaning of key concepts such as direct discrimination (disparate treatment); indirect discrimination (disparate impact); and when limitations on equality are legitimate. Later chapters test these concepts in some of the most challenging contexts: pregnancy and parenting, equal pay, reasonable accommodation, and sexual harassment; as well as to the particularly controversial issue of affirmative action or deliberate preference policies. Discussing at length how racisms, sexism, LGBTQ+ rights, and other topics impact these contexts. The final chapter asks how the right to equality can be made more effective, critically assessing the paradigm individual complaints model, and possible alternatives, from class actions and strategic litigation to mainstreaming and positive duties to promote equality.

Institutional Inequality and the Mobilization of the Family and Medical Leave Act - Rights on Leave (Paperback): Catherine R.... Institutional Inequality and the Mobilization of the Family and Medical Leave Act - Rights on Leave (Paperback)
Catherine R. Albiston
R1,374 Discovery Miles 13 740 Ships in 12 - 17 working days

How do Family and Medical Leave Act rights operate in practice in the courts and in the workplace? This empirical study examines how institutions and social practices transform the meaning of these rights to recreate inequality. Workplace rules and norms built around the family wage ideal, the assumption that disability and work are mutually exclusive, and management s historical control over time all constrain opportunities for social change. Yet workers can also mobilize rights as a cultural discourse to change the social meaning of family and medical leave. Drawing on theoretical frameworks from social constructivism and new institutionalism, this study explains how institutions transform rights to recreate systems of power and inequality but at the same time also provide opportunities for law to change social structure. It provides a fresh look at the perennial debate about law and social change by examining how institutions shape the process of rights mobilization.

Trico: A Victory to Remember - The 1976 Equal Pay Strike at Trico Folberth, Brentford (Hardcover): Sally Groves, Vernon Merritt Trico: A Victory to Remember - The 1976 Equal Pay Strike at Trico Folberth, Brentford (Hardcover)
Sally Groves, Vernon Merritt
R841 Discovery Miles 8 410 Ships in 9 - 15 working days

This is the story of the historic 21 week equal pay strike at Trico-Folberth in Brentford, West London, in 1976. TRICO - A Victory to Remember is indispensable to understanding how the 1970s marked a turning point in making women's rights a central focus for the labour movement, casting aside the minor role women were allocated in the mainstream. No longer could women's rights be given mere lip service. The strike was trail-blazing in many ways. It was the first time American-style picket-busting convoys of lorries and scab labour had been used against strikers who were mainly women. The employer, Trico, relied on legal loopholes in the new Equal Pay Act in presenting the case to a tribunal, which was boycotted by the strikers' trade union, the AUEW. However, despite the tribunal ruling in favour of the employer, the union nevertheless successfully negotiated equal pay. This achievement was unique, and led towards the Equal Pay Act being amended in 1983. The story of the strike, illustrated with stunning archive photos mostly unseen for over forty years, charts the women's campaign from its beginnings to their final victory, including anecdotes from some of those involved. There is a brief history of the struggle for equal pay in Britain, and a chapter on the relevance of the Trico dispute to today's society. Author Sally Groves worked at Trico from 1975 - 1980 on assembly and then as a trainee tool setter. She was one of the women on strike in 1976, and became the Trico AUEW Strike Committee's Publicity Officer. This book will inspire women everywhere; trade unionists and anyone suffering as a result of the gig economy. It will be of particular interest to those studying and researching issues of women's equality.

An Equal Place - Lawyers in the Struggle for Los Angeles (Hardcover): Scott L. Cummings An Equal Place - Lawyers in the Struggle for Los Angeles (Hardcover)
Scott L. Cummings
R1,351 Discovery Miles 13 510 Ships in 12 - 17 working days

An Equal Place is a monumental study of the role of lawyers in the movement to challenge economic inequality in one of America's most unequal cities: Los Angeles. Breaking with the traditional focus on national civil rights history, the book turns to the stories of contemporary lawyers, on the front lines and behind the scenes, who use law to reshape the meaning of low-wage work in the local economy. Covering a transformative period of L.A. history, from the 1992 riots to the 2008 recession, Scott Cummings presents an unflinching account of five pivotal campaigns in which lawyers ally with local movements to challenge the abuses of garment sweatshops, the criminalization of day labor, the gentrification of downtown retail, the incursion of Wal-Mart groceries, and the misclassification of port truck drivers. Through these campaigns, lawyers and activists define the city as a space for redefining work in vital industries transformed by deindustrialization, outsourcing, and immigration. Organizing arises outside of traditional labor law, powered by community-labor and racial justice groups using levers of local government to ultimately change the nature of labor law itself. Cummings shows that sophisticated legal strategy - engaging yet extending beyond courts, in which lawyers are equal partners in social movements - is an indispensable part of the effort to make L.A. a more equal place. Challenging accounts of lawyers' negative impact on movements, Cummings argues that the L.A. campaigns have achieved meaningful reform, while strengthening the position of workers in local politics, through legal innovation. Dissecting the reasons for failure alongside the conditions for success, this groundbreaking book illuminates the crucial role of lawyers in forging a new model of city-building for the twenty-first century.

Employment Policy and the Regulation of Part-time Work in the European Union - A Comparative Analysis (Paperback): Silvana... Employment Policy and the Regulation of Part-time Work in the European Union - A Comparative Analysis (Paperback)
Silvana Sciarra, Paul Davies, Mark Freedland
R1,512 R1,210 Discovery Miles 12 100 Save R302 (20%) Ships in 12 - 17 working days

This book originates from the research project 'New discourses in labour law' held at the European University Institute. A detailed analysis of part-time work regulation is presented for seven European countries, in order to ascertain how internal domestic choices of the legislatures have merged into the 'Open method of co-ordination'. The impact of European employment policies is considered in parallel with the implementation of the Directive on part-time work, thus providing a complete overview of both soft and hard law mechanisms available to national policy-makers. In this 2004 work, the interaction between law and policy emerges as a dynamic and constantly changing process of exchange between national and supranational actors, through the use of concrete examples of lawmaking. Labour law is put forward as being central in the current evolution of European law, and this centrality is presented as a confirmation of innovation and continuity in regulatory techniques.

The Racial Muslim - When Racism Quashes Religious Freedom (Paperback): Sahar F. Aziz The Racial Muslim - When Racism Quashes Religious Freedom (Paperback)
Sahar F. Aziz; Foreword by John L. Esposito
R700 Discovery Miles 7 000 Ships in 12 - 17 working days

Why does a country with religious liberty enmeshed in its legal and social structures produce such overt prejudice and discrimination against Muslims? Sahar Aziz's groundbreaking book demonstrates how race and religion intersect to create what she calls the Racial Muslim. Comparing discrimination against immigrant Muslims with the prejudicial treatment of Jews, Catholics, Mormons, and African American Muslims during the twentieth century, Aziz explores the gap between America's aspiration for and fulfillment of religious freedom. With America's demographics rapidly changing from a majority white Protestant nation to a multiracial, multireligious society, this book is an in dispensable read for understanding how our past continues to shape our present-to the detriment of our nation's future.

Markus Wiese
R2,244 Discovery Miles 22 440 Ships in 12 - 17 working days

Manfred Weiss; Christopher Rinckhoff
R2,020 Discovery Miles 20 200 Ships in 12 - 17 working days

Abbo Junker; Florian Schiffer
R1,690 Discovery Miles 16 900 Ships in 12 - 17 working days

Roman Seer; Andre Frischemeier
R1,918 Discovery Miles 19 180 Ships in 12 - 17 working days

Perspectives on Labour Law (Paperback, 2nd Revised edition): A.C.L. Davies Perspectives on Labour Law (Paperback, 2nd Revised edition)
A.C.L. Davies
R1,466 Discovery Miles 14 660 Ships in 12 - 17 working days

Policy discussions play an important role in labour law, and labour lawyers draw on a wide range of disciplines and approaches in order to construct their arguments. This 2009 overview of the basic principles of labour law and the related policy arguments introduces two of the main perspectives used in the analysis of labour law today human rights and economics. It offers a brief history of the influence of human rights and economics on labour law since the 1950s, explains neoclassical and new institutional economics and summarises the historical development of international human rights law. The insights of rights theorists and economists are then applied to a selection of topics in labour law, including anti-discrimination law, dismissal, working time, pay, consultation and collective bargaining, trade union membership and industrial action, in order to demonstrate the interplay between the two perspectives.

Social Rights and Market Freedom in the European Constitution - A Labour Law Perspective (Paperback): Stefano Giubboni Social Rights and Market Freedom in the European Constitution - A Labour Law Perspective (Paperback)
Stefano Giubboni
R1,290 Discovery Miles 12 900 Ships in 12 - 17 working days

This is an account of the development of European labour and social security law as it interrelates with the evolution of market integration in the European Union. Giubboni presents, from a labour law perspective, a case study of the changes the European Community/European Union has undergone from its origins to the present day and of the ways these changes have affected the regulation of European Welfare States at national level. Drawing on the idea of 'embedded liberalism', Giubboni analyses the infiltration of EC competition and market law into national systems of labour and social security law and provides a normative framework for conceptualising the transformation of regulatory techniques implemented at the EU level. This important, interdisciplinary contribution to research in EU social law illustrates how the vision of social protection and solidarity is changing.
