Der demographische Wandel in der Bundesrepublik Deutschland ist deutlich sichtbar. Anlasslich einer immer alter werdenden Bevoelkerung hat der Gesetzgeber 2007 aufgrund der wachsenden Zahl an pflegebedurftigen Personen das Pflegezeitgesetz geschaffen, um die Angehoerigenpflege in heimischer Umgebung zu foerdern. Die Arbeit untersucht die sich aus den Vorschriften des Pflegezeitgesetzes und dem 2012 hinzugekommenen Familienpflegezeitgesetz ergebenden arbeits- und sozialversicherungsrechtlichen Auswirkungen. Dazu werden die neuen Vorschriften im Einzelnen im Kontext des geltenden Arbeitsrechts betrachtet sowie die sich stellenden Probleme herausgearbeitet und einer Loesung zugefuhrt. Soweit erforderlich, werden Vorschlage zur Anpassung des Gesetzestextes und abschliessend ein Vorschlag fur ein einheitliches Pflege- und Familienpflegezeitgesetz gemacht.
Labour and the Wage: A Critical Perspective offers a new perspective on why labour law struggles to respond to problems such as low pay and under-inclusive employment. A Marxian-inspired ontological approach sheds new light on the role of labour law in a capitalist economy and on the limitations and potential of labour law when it comes to bringing about social change. It illustrates this through the lens of the wage. The book develops a legal genealogy that explores the shifting portfolio of concepts through which the wage has been conceptualized in legal discourse as capitalism has developed. This exploration spans from the Norman Conquest to the present day, and covers diverse issues such as the decasualization of the docks, sweated labour, the truck system, tax-credits, tips, and minimum wages. Labour and the Wage provides one of the most in-depth and comprehensive analyses of the wage to date, while, at the same time, shedding new light on the contradictory role, or function, of labour law in the context of capitalism.
Das Buch untersucht die rechtliche Grundlage von Videouberwachung von Arbeitnehmern in der Volksrepublik China. Videouberwachung ist in der VR China allgegenwartig und rechtliche Grenzen bestehen kaum. Die Autorin befasst sich mit der Rechtslage in Deutschland, um davon ausgehend nach Loesungen fur die in China bestehenden Konfliktlagen zu suchen. Sie setzt sich mit der Videouberwachung von Arbeitnehmern am oeffentlich zuganglichen Arbeitsplatz und in nicht oeffentlich zuganglichen Raumen auseinander. Die Autorin betrachtet das chinesische Arbeitsvertragsgesetz dahingehend, ob die Rechtsgrundlage auf der kollektiven Ebene fur den Arbeitnehmerschutz bei der Videouberwachung von Arbeitnehmern besteht.
In the decades following the globalization of the world economy, trafficking, forced labor and modern slavery have emerged as significant global problems. States negotiated the Palermo Protocol in 2000 under which they agreed to criminalize trafficking, primarily understood as an issue of serious organized crime. Sixteen years later, leading academics, activists and policy makers from international organizations come together in this edited volume and adopt an inter-disciplinary, multi-stakeholder approach to revisit trafficking through the lens of labor migration and extreme exploitation and, in the process, rethink the law and governance of trafficking. Die betriebliche Altersversorgung hat sich mittlerweile zu einem wesentlichen Bestandteil der Alterssicherung entwickelt. Lifetime Disadvantage, Discrimination and the Gendered Workforce fills a gap in the literature on discrimination and disadvantage suffered by women at work by focusing on the inadequacies of the current law and the need for a new holistic approach. Each stage of the working life cycle for women is examined with a critical consideration of how the law attempts to address the problems that inhibit women's labour force participation. By using their model of lifetime disadvantage, the authors show how the law adopts an incremental and disjointed approach to resolving the challenges, and argue that a more holistic orientation towards eliminating women's discrimination and disadvantage is required before true gender equality can be achieved. Using the concept of resilience from vulnerability theory, the authors advocate a reconfigured workplace that acknowledges yet transcends gender.
This book focuses on descriptions of the developments in legal frameworks and policies regarding the human rights of older persons. First, it covers the policies adopted and practices developed at the universal system, particularly within the sphere of the United Nations. Second, it includes a side-by-side comparison of the work of regional human rights mechanisms, which have picked up some momentum in the past decade. Through its inclusion of law, policy, and current processes, the widest net possible has been cast to collect a descriptive resource for advocates. Overall, we hope that this book contributes to a better understanding of the current limitations and possibilities that international institutions offer to uphold the human rights of older persons. We expect that this information will allow states and other policy makers to move forward with the international recognition of the human rights of older persons. We know this is only a first effort in compiling and reporting the standards that are being produced by different international institutions. But we have no doubt that many others will follow with their expert analysis of these emerging standards, and that the ongoing discussion will finally crystalize in international human rights binding instruments explicitly recognizing the universal rights of older persons.
