This book presents an analytical framework which assesses how 'land-for-peace' agreements can be achieved in the context of territorial conflicts between de facto states and their respective parent states. The volume examines geographic solutions to resolving ongoing conflicts that stand between the principle of self-determination (prompted by de facto states) and the principle of territorial integrity (prompted by parent states). The authors investigate the conditions under which territorial adjustments can bring about a possibility for peace between de facto states and their parent states. This book examines the development of cooperation between the EU and NATO, two key non-state actors in the European security architecture. The work examines the relationship between the EU and NATO by focusing on the perspective of member states. This book analyses the European Union's (EU) approach to peacebuilding in its Common Security and Defence Policy (CSDP) missions, and explores how this approach impacts the EU's role in international conflict management. This book investigates the end of the Cold War in Africa and its impact on post-Cold War US foreign policy in the continent. The fall of the Berlin Wall is widely considered the end of the Cold War; however, it documents just one of the many "ends", since the Cold War was a global conflict. This book looks at one of the most neglected extra-European battlegrounds, the African continent, and explores how American foreign policy developed in this region between the late 1980s and the early 1990s. Drawing on a wide range of recently disclosed documents, the book shows that the Cold War in Africa ended in 1988, preceding the fall of the Berlin Wall. It also reveals how, since then, some of the most controversial and inconsistent episodes of post-Cold War US foreign policy in Africa have been deeply rooted in the unique process whereby American rivalry with the USSR found its end in the continent. The book challenges the traditional narrative by presenting an original perspective on the study of the end of the Cold War and provides new insights into the shaping of US foreign policy during the so-called 'unipolar moment'. This book provides the first scholarly investigation of prosecutorial discretion in the International Criminal Court (ICC) from an interdisciplinary perspective. This work analyses the discretionary power of the ICC prosecutor and its scope. It explains that there is a tendency to overlook the necessity of distinguishing between the various usages of discretion when exercised as a power authorised by the law and effect when applying indeterminate legal thresholds. The author argues that the latter indeterminacy may give decision makers an unwarranted opportunity to exercise a wide range of discretion, where extra-legal factors may be considered. In comparison, prosecutorial discretion allows decision makers to consider extra-legal considerations. This book also discusses the relevance of political considerations within the decision-making process in the context of the exercise of prosecutorial discretion. It suggests that there need not be a conflict between the broad sense of justice as outlined in the Statute and political factors in giving effect to decisions. This book offers a novel and contemporary examination of the 'responsibility to protect' (R2P) doctrine from an international legal perspective and analyses how the doctrine was applied within the Libyan and Syrian conflicts as two recent and highly significant R2P cases. The United Nations Convention on the Law of the Sea (LOSC) represents one of the most successful examples of multilateral treaty making in the modern era. The convention has 168 States parties, and most non-signatory States recognise nearly all of its key provisions as binding under customary international law, including the United States. Nevertheless, there remain significant differences in interpretation and implementation of the LOSC among States as well as calls, on occasion, for its amendment. This book analyses the impact, influence and ongoing role of the LOSC in South East Asia, one of the most dynamic maritime regions in the world. Maritime security is a critical issue within the region, and it is separately assessed in light of the LOSC and contemporary challenges such as environmental security and climate change. Likewise, navigational rights and freedoms are a major issue and they are evaluated through the LOSC and regional state practice, especially in the South China Sea.
